The Mara Wanderlust – Tour Booking Terms and Conditions

Prices;

Prices include all expenses as outlined in the itineraries.

Transport;

Transportation, transfers, excursions, and tours shall be by our safari vehicles, which include 4×4 vehicles, wheel drives, safari minivans, saloon cars, trucks, or shuttle buses.

Bookings;

A deposit of at least 30% of the cost of the safari is required to confirm and reserve bookings prior to the safari date, subject to the availability of rooms and vehicles. International travelers must make their reservations at least 1 month in advance and pay the remaining balance latest 14 days before the start of the safari to ensure a smooth safari, unless otherwise agreed.

Payments;

All safaris must be fully paid before the commencement of the safari. All travelers must pay their deposits and balances only to the authorized company accounts; any payment out of these accounts must be authorized in writing and approved by the company management via official company communication channels. The company will not be liable for payments, offers, and agreements outside the official accounts by persons other than the company directors. Company currency exchange rates apply at all times.

Safari orientations;

Unless the safari is private, clients will share the safari facilities with others. Clients are therefore advised to be good-natured and enjoy being with others. Be prepared to encounter customs and habits, which may be different from your own, and form part of the adventure.

Changes in itineraries;

The sequence of itineraries is normally adhered to, but the company reserves the right to make alterations occasioned by weather, road works, high season congestion, or any other unforeseen circumstances. Any alterations by the clients to the agreed-upon itineraries should be made in then office. The company shall not be held liable for any complaint arising out of changes made between the client and the safari guide outside of the office. All changes must be reported to the office.

Cancellation and postponements;

In case a booking is canceled or postponed, the following cancellation fees shall apply; 

Domestic/Resident travelers

– 2 weeks before the date of travel – 100% refund, less transaction charges

– less than 2 weeks before the date of travel – 50% refund, less transaction charges

– No-show and less than 1 week before the date of travel: No refund.

 International travelers

– 1 month before the date of travel – 100% refund, less transaction charges

– 2 Weeks to the date of travel – 50% refund less transaction charges

– Less than 2 weeks and No show – No refund

Seasonal Factors and Resort Facilities

Some tourist facilities may be unavailable early or late in the season due to maintenance or closures. Public holidays, religious festivals, or maintenance work may also impact services and amenities, including pools, shops, and banks.

Wild Animals

Your safari may bring you close to wild animals. While rare, wildlife encounters can occur, and The Mara Wanderlust is not responsible for any incidents. Many safari camps are unfenced, and animals may pass through at any time.

Responsibility

Travel in Africa carries some risks, including poor road conditions, natural forces, and limited access to medical facilities. The Mara Wanderlust acts only as an agent for hotels, tours, transport, and other services provided by third-party suppliers. It is not liable for death, injury, or loss resulting from circumstances beyond its control.

The Mara Wanderlust reserves the right to change hotels or itineraries if needed due to road, weather, or airline disruptions. Baggage is carried at the traveler’s risk.

Safari Transport

Safari vehicles used in East Africa differ from tour vehicles in developed countries and typically do not have air-conditioning. Land Cruisers with sliding windows are used for overland safaris, and open-sided vehicles are common for game drives inside reserves.

Law and Jurisdiction

These terms are governed by Kenyan law, and any disputes must be resolved in Kenyan courts.

Issues/Complaints

If any issues arise during your safari, notify your tour manager immediately in writing (via email or WhatsApp) for prompt resolution. If unresolved, submit a formal complaint within 30 days of your safari’s end for investigation and action. Valid claims will be addressed within 30 days of receiving the complaint.
